Need a day off? Call in with the flu and get paid.

Our brilliant Congress just doesn’t have enough to do, apparently:  They’re trying to pass yet another intrusive law that forces employers to give 5 paid sick days per year to employees if they come to work sick with a contagious illness and are asked to leave, or if they call in with something catchy:

SEC. 3. PAID SICK LEAVE REQUIREMENT.

    (a) In General- An employer who directs an employee to leave work or not to come in to work because the employer believes the employee has symptoms of a contagious illness, or has been in close contact with an individual who has symptoms of a contagious illness, shall provide paid sick leave to the employee for each workday (or portion thereof) the employee complies with such direction, up to a maximum of 5 workdays per 12-month period.
    (b) Employee Compliance With Employer Direction- An employee shall be considered to be in compliance with an employer’s direction to leave work or not come in to work if the employee leaves work or does not come in to work when the employer instructs or advises the employee to do so because the employer believes that the employee–
    (1) has symptoms of a contagious illness; or
    (2) has been in close contact with an individual who has symptoms of a contagious illness.
Fine and dandy.  Now let’s list the laws of unintended consequences that will come from this law:
  1. Employees will fake contagious illness (i.e. running to the bathroom every five minutes and complaining about a sick stomach), so that they may be sent home with pay.
  2. Employees will be sure to use their allotted paid five contagious sick days per year by calling in.  What’s the employer going to say?  ”I know you’re faking?”  The vast majority of people will use paid time off if they have it coming.
  3. The cost, the cost, the cost.  While businesses–especially small ones–are already faltering in this economy, they’re going to pile yet another expense on top of the already nearly unsurmountable struggle these small and medium-sized business face.

Large business typically already provide paid sick time.  This law is a dagger into the heart of small business.  Period.

I thought this administration was all about “the little guy”?

Here’s a novel idea:  Maybe they should leave the business decisions to the business owners, eh?  Most of these congress creeps have never worked a real job in their lives let alone run a for-profit business, yet they believe that they have the knowledge necessary to make major business decisions for people who’ve been working their tails off their entire lives doing just that.

Where does this arrogance come from???
